  • Seasonal Contracts: Our services are primarily offered through **seasonal service contracts** detailing specific precipitation limits, rates, response times, and exclusions.
  • Final Contracts: Information and quotes provided on the website are estimates only. The legally binding agreement between the client and the Company is the **Written Seasonal Service Agreement or Single Service Contract** signed by both parties.

3. Service Conditions and Delivery

3.1 Priority and Response

Seasonal Contract clients receive priority over on-call (per-occurrence) services. While the Company endeavors to meet contractually stipulated response times, actual times may vary significantly during severe or prolonged weather events due to traffic congestion and storm intensity.

3.2 Property Access and Preparation

The client is responsible for ensuring service areas (driveways, parking lots, walkways) are clear of vehicles, equipment, or any obstructions that may impede the safe and efficient delivery of service. Any existing damage should be reported to the Company prior to the service season.

4. Pricing, Payments, and Billing

4.1 Pricing

Fixed seasonal prices and service specifics are detailed exclusively in the individual service contract.

4.2 Payments and Late Fees

All payments must be made according to the billing terms set forth in the contract. The Company reserves the right to **immediately suspend service** without notice if payment is significantly past due. Overdue accounts will be subject to a late fee or interest charge on the outstanding balance, as permitted by Massachusetts law.

5. Limitation of Liability and Disclaimer

CLIENT ACKNOWLEDGEMENT: THE CLIENT ACCEPTS THAT WEATHER IS UNPREDICTABLE AND THAT SNOW AND ICE REMOVAL CARRY INHERENT RISKS.

5.1 No Guarantee of Ice-Free Surfaces

The Company cannot guarantee that treated areas will remain completely free of snow and/or ice at all times. The service goal is to mitigate hazardous conditions to a commercially reasonable and feasible extent. **The client understands that snow and ice removal never fully eliminates the risk of slips and falls.**

5.2 Limitation of Liability for Damages

  • **Covered Damages:** The Company will make reasonable efforts to avoid damage to property (e.g., curbs, landscaping) during service. Accidental damages reported within 48 hours of the service will be investigated, and if determined to be caused by Company negligence, they will be repaired or compensated.
  • **Exclusions:** The Company **is not liable** for damage to non-visible items, hidden wires, poorly constructed structures, unmarked landscaping, or items placed near service areas. The Company is also not responsible for the pre-existing cracking or deterioration of concrete or asphalt.

6. Cancellation and Contract Termination

6.1 Client Cancellation

Specific terms and conditions for the termination of a Seasonal Service Contract (including any potential early termination fees or refund policies) are governed exclusively by the **written Seasonal Service Contract**.

6.2 Termination by the Company

The Company reserves the right to immediately terminate service for non-payment or for any other material breach of these Terms.

7. Intellectual Property

All content on the website (including text, logos, images, and designs) is the property of **Cesar’s Snow Removal** or used with permission. You may not reproduce, copy, or utilize such content without the express written permission of the Company.

8. Governing Law and Dispute Resolution
